International Penal Defense 1 - 2

There are two levels for this training:

This training is suited for lawyers, magistrates, and legal professionals who regularly use International Penal Court's mechanisms and applicable law. 

 

objective

The main objective is to train lawyers, magistrates and legal professionals to the use of international penal law and international penal procedure.

 

At the end of the training participants will be able: 

-   to spot the justice questions related to the complementarity between

    the International Penal Court (IPC) and domestic jurisdictions;

-   to identify the different international jurisdictions and their specificities;

-   to use Rome's Status and CPI rules of procedures and evidence-handling;

-   to raise and solve justice issues related to the Court's jurisdiction,

    and to the Court's  admissibility rules.

-   to identify crimes against humanity, genocide crimes, war crimes and

    crimes of agression. 

-   to raise and solve justice issues related to the cooperation between States and the IPC. 

 

The IPC has a vocation to try individuals convicted for genocide, war crimes, crimes against humanity and crimes of agression. It was set up July 1 2002. This jurisdiction's procedure, alike International Penal Ad Hoc Tribunals' and other international penal juridictions' procedures, is specific.

    •  International Justice background and evolution ;

    • Different international penal jurisdictions ;

► International penal jurisdictions competences: 

    • Rationae temporae competence, rationae loci, rationae materiae, rationae personae

► Applicable law before international penal jurisdictions : 

    • Status, Rule of Procedure and testimony and other founding texts of international penal jurisdictions; 

    • Other applicable law before international penal jurisdictions. 

 

DAY 2

International crimes : 

  • Genocide crimes.
  • Crimes against Humanity.

  • War crimes. 

  • Crimes of agression. 

IPC procedure and its differents bodies : 

  •  IPC referral.

  •  Complementarity and admissibility principles.

  •  Victims participation

  • Procedure phases (preliminary phase, first instance, appeal andPhase de procédure ( la phase préliminaire, première instance, appel e révision)

- Case-analysis, situation-simulation, switch between small and big group works, roles plays. 

- Texts records on penal jurisdictions procedures and the IPC will be used as a reference for every step of the training.
